Mosman tobacconist hit with 90-day shutdown for selling illicit smokes and vapes.

A shopfront on Spit Road in Mosman has been shut down immediately for 90 days under NSW Health’s tough new tobacco and vaping laws – as inspectors reveal 30 more stores across NSW have been closed in the past 10 days.
An Official Closure Order has been posted at 44 Spit Road, Mosman, stating the premises is closed from 2 March 2026 to 30 May 2026 (inclusive).

The store was one of 30 closed in the past month, under the State’s tough new tobacco and vaping laws.
The order – issued under the Public Health (Tobacco) Act 2008 -says NSW Health has “reasonable suspicion” a relevant breach has occurred or is likely to occur at the premises, namely the sale of illicit tobacco.
The notice warns it is an offence to interfere with the order, with maximum penalties of $11,000.
It also states that while the premises is closed, entering without a reasonable excuse can attract maximum penalties of $82,500 for a first offence and $137,500 for second and subsequent offences. Selling any product from the premises during the closure period is also an offence unless an exemption has been granted.

Bright yellow notices have been placed on the windows of the store, alerting the community to its sudden closure.

The Mosman closure comes as NSW Health confirmed inspectors have now issued 105 short-term orders since new laws strengthening tobacco and vaping controls came into effect in November 2025.
In a statewide update, NSW Health said that over the past 10 days, a further 30 stores across multiple Local Health Districts -including Northern Sydney – were shut down for 90 days for alleged breaches involving illicit tobacco, illegal vaping goods, or selling tobacco without a licence.

The store – located at 44 Spit Rd – has been operating as a Tobacconist since 2025.
During enforcement action at those 30 premises, inspectors said they seized about 700,000 illicit cigarettes and 3,900 illicit vapes, with further investigations underway and possible prosecutions to follow.
The enforcement milestone lands on the eve of a further increase to the federal tobacco excise, with NSW Health warning the growing price gap between legal and illegal tobacco is fuelling concern about the illicit market.
Health Minister Ryan Park said the recent closures should serve as a warning, adding that with more inspectors on the ground, enforcement will “ramp up” and repeat offenders can be shut down again.

NSW Health’s broader reforms also include:
- new offence for possessing a commercial quantity of illicit tobacco (maximum penalty over $1.5 million and 7 years’ imprisonment, or both)
- New penalties for selling illicit tobacco (maximum penalty over $1.5 million and 7 years’ imprisonment, or both)
- New lease termination powers for landlords where a closure order is in place
- New offences for falsely claiming to be licensed, resisting seizure, and attempting to retake seized products.
